Terms and conditions of Galerie Shia Bender in Düsseldorf for the online shop at www.kanjotake.com (status: 18 April 2019)

  • 1 Introduction

These Terms and Conditions (the “Terms”) govern all business between Galerie Shia Bender in Düsseldorf and the Customer to the exclusion of any terms and conditions of the Customer. Any terms and conditions of the Customer are only valid if agreed in writing by Galerie Shia Bender. By placing an order, the Customer is deemed to have accepted these Terms.

  • 2 Execution of customer orders

Galerie Shia Bender undertakes to make every endeavour to execute each order to the best of its knowledge and belief. Ordered merchandise (posters) will be sent to the Customer by post. The object of the contract is printed posters with motifs by the artist Kanjo Také.

  • 3 Liability and warranty

In no event is Galerie Shia Bender responsible or liable for loss or damage of any kind whatsoever (including, without limitation, loss of business, damage caused by default or loss of profit) suffered as a result of using the poster. The liability of Galerie Shia Bender is limited in any event to an amount equal to the invoice value excluding VAT (net price) of the poster. Galerie Shia Bender accepts no liability for any loss or damage that may arise during processing or transmission when using communication technologies (e-mails, data transfers, etc.).

  • 4 Exchange and disputes

The posters are hand signed by the artist and are one-of-a-kind artwork that cannot be exchanged. By ordering the poster, the Buyer (Customer) accepts that the merchandise is non-returnable.

  • 5 Payment

All prices displayed on the website are gross prices including VAT at 19%.

  • 6 Copyright

The copyright and all other intellectual property rights in the poster motifs are wholly owned by Galerie Shia Bender. These Terms do not grant the Buyer the right to use any of the motifs. Copying or publication, whether in whole or in part, is strictly prohibited.

  • 7 Updates of these Terms

Galerie Shia Bender reserves the right to update any part of these Standard Terms and Conditions at any time without prior notice. The most current version of these Terms can be accessed at any time on this site and applies in its entirety. Should any individual provision or any part of any provision of these Standard Terms and Conditions be or become illegal, void or unenforceable, the validity of the remaining provisions hereof shall in no way be affected. In such case, the void and/or unenforceable provision or provisions shall be replaced exclusively by the legal provisions.

  • 8 Place of jurisdiction

All business between Galerie Shia Bender and the Customer is governed by and construed in accordance with German law. Any disputes are subject to the exclusive jurisdiction of the courts of Germany. The place of jurisdiction is Düsseldorf.
